s.c.: acto ou efeito de reclamar; reivindicação; protesto.
Do despacho que não admita a apelação, a revista ou o agravo e, bem assim, do despacho que retenha o recurso, pode o recorrente reclamar para o presidente do tribunal que seria competente para conhecer do recurso.
A reclamação, dirigida ao presidente do tribunal superior, é apresentada na secretaria do tribunal recorrido, dentro de 10 dias, contados da notificação do despacho que não admita ou retenha o recurso. O recorrente exporá as razões que justificam a admissão ou a subida imediata do recurso e indicará as peças de que pretende certidão.
A reclamação é autuada por apenso e apresentada logo ao juiz ou ao relator, para ser proferida decisão que admita ou mande seguir o recurso ou que mantenha o despacho reclamado; no último caso, na decisão proferida sobre a reclamação pode mandar juntar-se certidão doutras peças necessárias.
Se o recurso for admitido ou mandado subir imediatamente, o apenso é incorporado no processo principal; se for mantido o despacho reclamado, é notificada a parte contrária para responder, em 10 dias, junta certidão das peças indicadas pelas partes e pelo tribunal e remetido o apenso ao tribunal superior.
Recebido o processo no tribunal superior, é imediatamente submetido à decisão do presidente, que, dentro de 10 dias, resolverá se o recurso deve ser admitido ou subir imediatamente.
As partes são logo notificadas da decisão proferida na reclamação, baixando o processo para ser incorporado na causa principal e lavrando o juiz ou o relator despacho em conformidade com a decisão superior.
Só o credor que goze de garantia real sobre os bens penhorados pode reclamar, pelo produto destes, o pagamento dos respectivos créditos.
A reclamação terá por base um título exequível e será deduzida no prazo de 15 dias, a contar da citação do reclamante; é, porém, de 25 dias, a contar da citação às entidades referidas nas leis fiscais, o prazo em que ao M.P. é facultada a reclamação dos créditos da Fazenda Nacional.
As reclamações são autuadas num único apenso ao processo de execução.
Findo o prazo para a dedução dos créditos, proferir-se-á despacho a admitir ou a rejeitar, liminarmente, as reclamações que hajam sido apresentadas.
As reclamações podem ser impugnadas pelo exequente e pelo executado no prazo de 15 dias, a contar da notificação do despacho que as haja admitido.
