Os poderes jurídicos das regiões autónomas são limitados: limitados, porque o texto constitucional é opaco precisamente naquilo em que deveria estar bem delimitado; limitados, pela própria actuação dos órgãos regionais que não sabem ou não querem fazer uso das possibilidades que, apesar de tudo, a Lei Fundamental portuguesa permite.24
O Acórdão 239/2005 é do Tribunal Constitucional. Neste processo de fiscalização abstracta da constitucionalidade, com mandato de "decisão" com força obrigatória geral (vulgo "força de lei"), o Tribunal Constitucional não deu razão à Assembleia Legislativa da Madeira no sentido pretendido. A Assembleia questionou a inconstitucionalidade de uma norma da Lei Constitucional nº 1/2004 (lei da sexta revisão da Constituição), a qual previa (vale a pena a transcrição) «a revisão da lei eleitoral para a Assembleia Legislativa da Região Autónoma da Madeira terá em conta a fixação do número de deputados entre um mínimo de 41 e um máximo de 47 e o reforço do princípio de representação proporcional, prevendo a lei, se necessário, para este efeito, a criação de um círculo regional de compensação». O mesmo preceito prevê para os Açores aquela parte do «reforço do princípio da proporcionalidade, com salvaguarda do princípio da representação por ilha».
Deste Acórdão vale a pena distinguir isto: o conteúdo da norma constitucional em questão, os comandos normativos diferentes para cada Região Autónoma; depois a análise da justificação do parlamento da Madeira, e a fundamentação do Tribunal Constitucional e, por fim, o caminho que não foi feito.
Temos dúvidas sobre a constitucionalidade da norma constitucional (a isso voltaremos mais à frente). Mas, independentemente desse juízo, de um já não se livram os partidos políticos que sustentaram tal revisão: trata-se de uma norma constitucional que demonstra bem o nível político da política em geral. A revisão da Constituição tem um objecto que é precisamente a sua revisão; por muito interessantes que sejam quaisquer outros assuntos, a legitimidade da Assembleia da República no acto da revisão do texto constitucional é exclusivamente esse e não outro.
