A Lei Constitucional nº 1/2004 de 24 de Julho pode constituir-se hoje de uma lei inconstitucional, violadora dos históricos direitos constitucionais das regiões autónomas insulares dos Açores e da Madeira; e pode constituir-se amanhã de uma "lei carrasco" dos sistemas legislativos daquelas regiões. Hoje o quadro é feio. E amanhã?16
Faltam ainda quatro meses para o fim do ano 2004, razão pela qual poderei estar errado na qualificação de que a Lei Constitucional nº 1/2004 de 24 de Julho é a pior lei que Portugal produziu este ano. Mas, embora não se possa garantir a impossibilidade de se realizar uma nova revisão constitucional (emendando-a), é muito improvável que nestes quatro meses se altere a Constituição Portuguesa, seja por razões tempestivas, sejam políticas e seja até pela própria natureza das coisas. Mas mesmo que um caso verdadeiramente excepcional permitisse alterar aquela Lei Constitucional - já nós portugueses não nos podemos esquivar de estarmos perante uma lei que é a pior feita em Portugal neste ano 2004 e é, inclusivamente, uma das piores leis realizadas em Portugal desde 1976, constituindo, em certo sentido, um golpe de estado legal às regiões autónomas insulares quer pelo seu conteúdo, quer pela sua oportunidade.
O que é uma lei constitucional?: é uma lei que consubstancia a Constituição da República Portuguesa. Ora, a importância duma lei desta natureza é evidente. É na sua base que está garantida a titularidade de "Estado de Direito", Estado com um conjunto de princípios fundamentais e de garantias dos cidadãos. Ou seja, uma lei constitucional é o que suporta verdadeiramente, do ponto de vista legal, mas não só, a comunidade portuguesa enquanto Estado.
A Lei Constitucional nº 1/2004 de 24 de Julho, é má por isto: antes, as regiões autónomas podiam legislar em todas as matérias concorrenciais, desde que fundamentassem com um interesse específico; ou ainda, podiam legislar em contrário das leis gerais da República desde que respeitassem os seus princípios fundamentais. Ou seja, em teoria, a Constituição no seu próprio texto supra legal oferecia um amplo poder às regiões autónomas - bastava para tanto que fundamentassem a sua legislação com o seu interesse específico, isto é, com o fundamento da necessidade em criar legislação diferente para a região política que o órgão de governo próprio administra. É certo que o Tribunal Constitucional servia de limite a este poder; também é certo que o Ministro da República...
