A competência do Representante da República hoje é idêntica à que o Ministro da República tinha em 1997 ou 2004. Mas o estatuto de representante da República (e já não do Estado) aumentou-lhe significativamente o poder político.33 Logo, aquilo que aparenta quebra, afinal, é um fortalecimento.
O Presidente da República, Cavaco Silva, por despacho de 21 de Março publicado no dia 30 desse mês, nomeou o 8º representante do Estado português para a Região Autónoma dos Açores, José António Mesquita, cargo designado pela Constituição de Representante da República.
Como veremos, distinguimos competência de poder: o primeiro prende-se com as normas legais, o segundo pressupõe a norma, mas vai mais além desta. Isto é, a norma contém um conjunto de comandos - que designamos de competências. Depois esses comandos são operacionalizados consoante o titular do cargo. Ou seja, uma coisa é a norma, as palavras, outra é a dialéctica sociológica e filosófica que preenche as palavras da norma. Ou seja ainda, é possível, ou melhor, é normal a verificação "estática" e a "dinâmica", a primeira que se refere à norma propriamente dita, a segunda que se refere à sua aplicação. Mas entre esse mundo existe ainda a hermenêutica jurídica, porque uma coisa é a norma, estática e lida sem dogmática jurídica, outra é a norma olhada com atenção ao ordenamento jurídico - em particular em conformidade com a Constituição.
Eis as nossas coordenadas.
Quais são, na generalidade, as competências do Representante da República nos termos da Constituição da República Portuguesa? Dois blocos distintos, um jurídico e outro político.
Na esfera jurídica, isto é, na sua competência em que se exige uma actuação com fundamento em razões de lei, possui:

Competência para assinar e mandar publicar os decretos legislativos regionais (do parlamento) e os decretos regulamentares regionais (do executivo).

Competência para, na fiscalização preventiva, vetar normas de decretos legislativos regionais, remetendo esse "veto" ao Tribunal Constitucional.

Competência para, após pronúncia pela inconstitucionalidade na fiscalização preventiva referida na alínea B) anterior, não assinar o diploma devolvendo-o ao parlamento.

Competência para, após reconfirmação por maioria qualificada por parte do parlamento do decreto legislativo regional que tenha sido declarado em desconformidade constitucional pelo Tribunal Constitucional, assinar o diploma.
