No texto anterior (página 51) analisámos a competência e o poder do Representante da República - na perspectiva da Constituição e ainda assim na sua relação com os órgãos próprios da Região Autónoma. 34Mas o Representante da República tem, ainda no âmbito estritamente constitucional, outros comandos - que são, já não no relacionamento directo com os órgãos próprios enquanto órgão nacional com competência e poder ao nível da autonomia, mas comandos individuais, ou seja, directrizes que lhe orientam num sentido unitário independente dos órgãos autonómicos.
Se distinguimos competência de poder, aquele referente à norma, este referente ao ordenamento jus-político em geral, temos agora que manter essa nomenclatura - que nos é útil para percebermos a dimensão daquela autoridade.
No plano jurídico, o Representante da República, na fiscalização abstracta da constitucionalidade e da ilegalidade, pode suscitar junto do Tribunal Constitucional declaração, com força obrigatória geral, de desconformidade de um diploma ou norma, estadual ou regional, que viole direitos da Região Autónoma. Isso é muito importante porque a violação desses direitos pode ser feita não exclusivamente pelos órgãos do Estado, mas também pelos órgãos autonómicos.
Dois exemplos, um nacional e outro regional. Demonstrámos nos textos das páginas 7 e 9, que a Lei Constitucional nº 1/2004, de 24 de Julho, na parte em que retirou as matérias que a Constituição instituía desde logo como sendo matérias que fundamentavam a região autónoma a legislar, era violadora quer da Constituição (limite material das revisões constitucionais) quer desse direito adquirido da Região Autónoma. Logo, o Representante da República tem aqui competência para na fiscalização abstracta suscitar essa inconstitucionalidade. E, como temos vindo a demonstrar, os órgãos regionais estão limitados pelo princípio da permanência mínima, isto é, os requisitos de acessibilidade a nível nacional que obrigam os cidadãos não podem ser aumentados a nível regional; logo, aquele diploma regional que aumenta os requisitos da mobilidade profissional dos funcionários na Região Autónoma, pode ser sujeito, na fiscalização abstracta, a um juízo de inconstitucionalidade por violar esse direito das regiões autónomas por parte do Representante da República junto do Tribunal Constitucional.
