É nas relações institucionais que se vê o grau de profundidade de uma democracia. 18O princípio da legalidade e da publicidade são estruturais, mas as instituições são o exemplo prático, o barómetro duma qualidade em teoria já muito duvidosa.
Aqui e ali temos vindo a discutir diversas questões da autonomia e temos ali e acolá projectado a ideia de que o sistema autonómico dos Açores e da Madeira é imperfeito, que piorou com a revisão da Constituição em 2004; que os órgãos parlamentares das regiões não tem sabido aproveitar o que é aproveitável do sistema; que os órgãos do Estado têm uma visão centralista e, pior, desfasada da realidade autonómica; que as imperfeições constitucionais deveriam ser colmatadas pelos estatutos político-administrativos e tantas coisas mais que temos vindo a desenhar.
A questão deste texto é mais simples - embora sobre um assunto dos mais pertinentes da dialéctica autonómica: o comportamento político das instituições e vem a propósito da Resolução nº 7/2005/M de 11 de Julho do parlamento da Madeira. Por motivos de espaço omitimos a apresentação dessa resolução.19
A Lei Constitucional nº 1/2004 de 24 de Julho trouxe (entre outras) duas normas importantes: uma interna sobre a iniciativa legislativa das regiões relativa à eleição dos deputados às assembleias regionais; e uma externa sobre a obrigatoriedade de em certo prazo os parlamentos regionais promoverem aquela iniciativa legislativa.
A interna é, objectivamente, um melhoramento do sistema: pela primeira vez consagra na Lei Fundamental essa legitimidade de apresentar projectos de lei eleitoral - tal como o era antes (e ainda, entenda-se) esse poder para os projectos dos respectivos estatutos político-administrativos das regiões autónomas.
A externa, como já tivemos oportunidade de dizer noutro texto, não só é desnecessária como, inclusivamente, levanta muitas questões desnecessárias mas não por isso pertinentes e inibidoras do normal funcionamento das instituições políticas.
A antedita Resolução formula cinco questões em forma de solicitação de «pareceres jurídicos a reputados constitucionalistas», razão suficiente para nada sobre elas dizermos agora e ficarmos atentos às respostas encontradas.
