Nos textos anteriores (páginas 51 e 56) analisámos, na perspectiva da Constituição, a competência e o poder do Representante da República na sua relação com os órgãos próprios da Região Autónoma, e, a sua autoridade enquanto entidade independente dos órgãos autonómicos.35Como projectámos veremos agora o horizonte do Estatuto Político-Administrativo.
Para melhor entendermos o sistema, convém fazer o retrato mais sintético do poder constitucional:
Na relação com os órgãos próprios tem o Representante da República:

Competência para assinar e mandar publicar as leis regionais (decreto legislativo regional e decreto regulamentar regional).

Competência para, na fiscalização preventiva, realizar os vetos jurídicos e políticos, o primeiro dirigido ao Tribunal Constitucional, o segundo dirigido ao órgão legiferante. E, como vimos, neste âmbito existem variantes.

Competência para nomear o Governo Regional e exonerar os membros daquele.
No funcionamento enquanto entidade independente dos órgãos autonómicos tem o Representante da República:

Na fiscalização abstracta da constitucionalidade e da ilegalidade, pode suscitar junto do Tribunal Constitucional declaração, com força obrigatória geral, de desconformidade de um diploma ou norma, estadual ou regional, que viole direitos da Região Autónoma ou o Estatuto Político-Administrativo.

Na relação institucional entre o Presidente da República, o Representante da República pode ter um vasto poder político em termos, por exemplo, do princípio da audição, quanto à marcação de eleições regionais, nas mensagens ao parlamento regional e na dissolução deste.
Podemos agora partir para a descoberta do Estatuto Político-Administrativo. Aquele esquema anterior agora é-nos útil:

Repetição do poder previsto nas alínea anteriores. Ou seja, o Representante da República encontra no Estatuto Político-Administrativo o mesmo poder que a Constituição lhe oferece.

Poder de abrir a primeira sessão de cada legislatura do parlamento e dirigir mensagens.

Poder de exonerar o Presidente do Governo Regional a pedido deste.

O Estatuto ainda prevê dois ou três pormenores, uns já desfasados da realidade e outros que já foram expurgados em virtude da evolução da Constituição através das últimas revisões.
Expurgados os poderes de superintendência do Representante da República nos serviços do Estado na Região através de delegação do governo central, e o assegurar o governo das ilhas em caso de dissolução...
