Embora o cargo de Representante da República tenha sofrido algumas alterações nos seus poderes nas revisões constitucionais mais recentes, em particular as de 1997 e de 2004, nada foi alterado, substancialmente, quanto ao que concerne especificamente ao sistema autonómico.29
Sobre o Representante da República escrevemos, além de outros mais antigos, dois textos nas páginas 34 e 37. No primeiro fizemos uma abordagem em termos de evolução do cargo e concluímos que a evolução constitucional da alteração das atribuições do Representante da República foi sintomática do ponto de vista político, mas, ao nível de sistema, são alterações mais de forma do que de conteúdo. No segundo, perspectivámos o cargo no plano da dicotomia dos açorianos funcionários públicos da administração pública autónoma e os da administração central e concluímos que já era um erro não aproveitar-se as normas que permitiam o Representante da República, em representação da República, lutar pelos açorianos da organização do Estado na Região; agora, com a expurgação destas normas, o erro ainda é maior.
Agora, a este propósito, interessa-nos verificar outra vertente: qual afinal a natureza dessa figura. Duas linhas condutoras constitucionais que coincidem com os governos sociais-democratas e com os governos socialistas: num primeiro momento, embora a prática não fosse bem essa, o Representante da República tinha a seu cargo a coordenação das actividades dos serviços centrais e exercia os poderes de superintendente nas funções administrativas exercidas pelo Estado na Região, coordenando-as com as desenvolvidas pela Região. Já num momento posterior, este perde essa capacidade.
Isto é o que está muito evidente, mas esconde-se por detrás dessa realidade uma outra: o porquê de um e de outro sistema.
O que se pretendia?, o que estava na norma? e o que foi efectivamente? Não era possível dar às regiões autónomas uma liberdade ao ponto de assinarem as suas leis. As então experiências mais recentes, como as regiões autónomas do ultramar mais significativas (Angola e Moçambique), embora tivessem a designação de "Estados" e embora pudessem legislar, tratava-se de um sistema intrincado: com o mesmo poder legislativo quer a assembleia legislativa quer o governador e, no plano nacional, a assembleia nacional, o governo e o próprio ministro do ultramar. Portanto, quanto aos Açores e à Madeira teria de existir uma entidade que, com o poder do veto jurídico e político, pudesse...
