Dissemos no texto anterior (página 61) que nem a actual Lei de Finanças Regionais (LEFRA) nem a que se discute neste momento para substituir aquela servem às regiões autónomas. 40Dissemos que não servem: A) porque estão deslocadas do lugar próprio, B) porque não cumprem a Constituição e C) porque inventam um sistema alheio e prejudicial ao sistema autonómico.
Vejamos cada uma destas questões tendo em atenção que, não havendo ainda em rigor uma lei de alteração da actual, não vamos analisar o que está em discussão. Quando a lei estiver aprovada faremos essa abordagem, que é da lei e das normas e não do debate político.

a Lei de Finanças Regionais (LEFRA) está deslocada do lugar próprio. Não é a LEFRA exclusivamente uma questão financeira, como dissemos já. Ela traduz, ou melhor, tem de transportar todos os elementos de sobrevivência da autonomia política. Está deslocada do lugar próprio que é o Estatuto Político-Administrativo o que, como se tem vindo a verificar sobremaneira, não garante uma serenidade necessária e apropriada a uma região autónoma que tem necessariamente de possuir a equivalente dignidade própria de Estado.
A questão central não está na LEFRA e nem sequer no Estatuto, mas sim na Constituição, ela própria remetendo para aquelas leis. Repare-se no texto da Constituição quanto à região autónoma: compete «dispor, nos termos dos estatutos e da lei de finanças das regiões autónomas, das receitas fiscais nelas cobradas ou geradas, bem como de uma participação nas receitas tributárias do Estado, estabelecida de acordo com um princípio que assegure a efectiva solidariedade nacional, e de outras receitas que lhes sejam atribuídas e afectá-las às suas despesas» (artigo 227/1/j). E agora quanto às autarquias locais: «o regime das finanças locais será estabelecido por lei e visará a justa repartição dos recursos públicos pelo Estado e pelas autarquias e a necessária correcção de desigualdades entre autarquias do mesmo grau» (artº 238/2). Há uma equiparação entre as autarquias locais e as regiões autónomas que não é admissível: uma distribuição de receitas (embora com âmbitos diferentes); e há um distanciamento de princípio que é de difícil admissão: numa lado uma "justa repartição", noutro a "efectiva solidariedade nacional".
