Despacho conjunto n.º 216/2001. - A generalidade das populações de peixes diádromos (lampreia-marinha, sável, savelha, salmão, enguia) em Portugal apresenta sinais evidentes de redução de abundância, exigindo medidas específicas de ordenamento que permitam a sua recuperação e assegurem uma gestão compatível com princípios de conservação das espécies e de sustentabilidade da pesca.
A gestão das pescas nas bacias hidrográficas é exercida por duas entidades distintas em duas zonas separadas, a zona mais a jusante, sob jurisdição da autoridade marítima, onde a competência em matéria de legislação é da Direcção-Geral das Pescas e Aquicultura (DGPA), e a zona, a montante, sob jurisdição da autoridade florestal, onde a competência em matéria de legislação é da Direcção-Geral das Florestas (DGF).
Apesar de reconhecer as especificidades e terminologia própria que caracterizam localmente a actividade, nomeadamente no que toca aos métodos e artes de pesca, esta legislação, em alguns casos, apresenta disparidades que aconselham uma análise ponderada das diversas questões envolvidas, em particular as relativas à conservação da natureza e as referentes à sócio-economia das populações dependentes do rio, por forma que os pescadores tenham a noção clara de uma maior justiça na gestão dos recursos, ponto de partida para que assumam um papel mais interventivo e co-responsável.
Sem prejuízo de uma maior colaboração entre os organismos intervenientes no sentido de melhorar o conhecimento existente sobre estes recursos, incluindo as suas necessidades ecológicas e os efeitos da pesca sobre essas populações, importa, desde já, analisar a possibilidade de alterar as normas vigentes sobre a matéria, pelo que se constitui agora um grupo de trabalho formado pelas entidades com responsabilidades directas na elaboração de legislação.
Assim, determina-se o seguinte: 1 - É criado um grupo de trabalho, com vista a: a) Apresentação de uma proposta de metodologia para harmonização das legislações aplicáveis aos peixes diádromos, nas diferentes zonas das bacias hidrográficas do continente; b)...
