Aviso n. 173/2008

Por ordem superior se torna público ter o Governo da Indonésia efectuado, junto do Secretário -Geral das Naçóes Unidas, em 2 de Fevereiro de 2005, uma retirada de reserva respeitante à Convençáo sobre os Direitos da Criança.

Notificaçáo

The Secretary -General of the United Nations, acting in his capacity as depositary, communicates the following:

The above action was effected on 2 February 2005. The reservation in question reads as follows:

The 1945 Constitution of the Republic of Indonesia guarantees the fundamental rights of the child irrespective of their sex, ethnicity or race. The Constitution prescribes those rights to be implemented by national laws and regulations.

The ratification of the Convention on the Rights of the Child by the Republic of Indonesia does not imply the acceptance of obligations going beyond the Constitutional limits nor the acceptance of any obligation to introduce any right beyond those prescribed under the Constitution.

With reference to the provisions of articles 1, 14, 16, 17, 21, 22 and 29 of this Convention, the Government of the Republic of Indonesia declares that it will apply these articles in conformity with its constitution.

The Secretary General wishes to refer to article 51 (3) of the Convention which reads as follows:

'Reservations may be withdrawn at any time by notification to that effect addressed to the Secretary -General of the United Nations, who shall then inform all States. Such notification shall take effect on the date on which it is received by the Secretary -General.'

O Secretário -Geral da Organizaçáo das Naçóes Unidas, agindo na sua qualidade de depositário, comunica o seguinte:

A acçáo acima referida foi efectuada em 2 de Fevereiro de 2005.

A reserva em questáo lê -se como se segue:

A Constituiçáo da República da Indonésia de 1945 garante os direitos fundamentais da criança, independentemente do sexo, da etnia ou da raça. A Constituiçáo prevê que tais direitos sejam aplicados pelos regulamentos e leis nacionais.
