Resolução n.º 236/79, de 03 de Agosto de 1979
Resolução n.º 236/79 1 - O problema dos refugiados e dos apátridas em Portugal encontra-se intimamente relacionado com o processo de descolonização.
Com efeito, alguns milhares de pessoas regressadas dos países africanos de expressão portuguesa constituem um grupo extremamente diversificado, do qual fazem parte indivíduos cuja nacionalidade não se encontra definida, ou que não possuem nacionalidade, ou ainda que, sendo nacionais dos países atrás referidos, permanecem em Portugal por motivos políticos, económicos ou de mera conveniência pessoal. A situação destas pessoas torna-se difícil, sobretudo por falta de documentação e por dificuldade de acesso ao trabalho ou a qualquer esquema de protecçãosocial.
2 - As acções dirigidas aos refugiados em geral encontram-se actualmente dispersas por vários organismos: delegação do Alto-Comissariado das Nações Unidas para os Refugiados (ACNUR), Comissariado para os Desalojados, Ministérios da Administração Interna, da Justiça e dos Negócios Estrangeiros e ainda entidades públicas e privadas de acção social ou benemerentes, tais como a Misericórdia de Lisboa e a Cruz Vermelha Portuguesa.
3 - O ACNUR iniciou o apoio aos refugiados em Portugal por meio de um acordo assinado em Agosto de 1975 com a Misericórdia de Lisboa. Na sequência do processo de descolonização, o ACNUR tem recorrido preferencialmente ao Comissariado para os Desalojados, através do IARN, organismo de natureza transitória, cujas acções, por força do Decreto-Lei n.º 401/78, de 15 de Dezembro, se encontram em vias de integração na Secretaria de Estado da Segurança Social.
4 - Entretanto, têm sido assinados vários acordos parciais, sem que exista qualquer sistema de coordenação.
Torna-se, pois, necessário e urgente criar uma estrutura de apoio que se ocupe da problemática em questão e constitua interlocutor válido para o ACNUR e outros organismos, permitindo assim o estabelecimento de acordos globais.
