Resolução n.º 3/2006, de 10 de Janeiro de 2006
Resolução do Conselho de Ministros n.º 3/2006 A Resolução do Conselho de Ministros n.º 62/2004, de 17 de Maio, determinou a alteração do Plano de Ordenamento da Orla Costeira de Caminha-Espinho, aprovado pela Resolução do Conselho de Ministros n.º 25/99, de 7 de Abril, nas áreas actualmente abrangidas pelos planos de praia, nas áreas de protecção costeira, bem como nas áreas com aptidão balnear não sujeitas actualmente a planos de praia, integradas nos municípios de Caminha, Espinho, Esposende, Matosinhos, Póvoa de Varzim, Viana do Castelo, Vila do Conde e Vila Nova de Gaia, cometendo ao Instituto da Conservação da Natureza a elaboração técnica desta alteração.
Constata-se agora que a maior parte da área de intervenção do POOC não abrange áreas de intervenção do Instituto da Conservação da Natureza e que, por tal motivo, os trabalhos técnicos de elaboração da alteração se encontram, ainda, em fase muito incipiente.
Considerando que os planos especiais de ordenamento do território visam estabelecer regimes de salvaguarda de recursos e valores naturais, assegurando a permanência dos sistemas indispensáveis à utilização sustentável do território, que, no caso dos planos de ordenamento da orla costeira, incidem, principalmente, sobre território sob a jurisdição do Instituto daÁgua; Considerando que os objectivos da alteração definidos no n.º 2 da Resolução do Conselho de Ministros n.º 62/2004, de 17 de Maio, têm essencialmente que ver com a avaliação da classificação das praias e com as tipologias e dimensões dos apoios de praia, pelo que a entidade mais habilitada para proceder à elaboração da alteração do Plano de Ordenamento é o Instituto da Água; Considerando que o prazo definido para a elaboração da alteração do Plano há muito que foi ultrapassado, encontrando-se os estudos ainda em fase muito incipiente, pelo que se torna necessário reponderar os prazos de elaboração daalteração; Tendo sido ouvidas as Câmaras Municipais de Caminha, Espinho, Esposende, Matosinhos, Póvoa de Varzim, Viana do Castelo, Vila do Conde e Vila Nova de Gaia: Assim: Nos termos da alínea g) do artigo 199.º da Constituição, o Conselho de Ministrosresolve: 1 - Alterar os n.os 3, 5 e 12 da Resolução do Conselho de Ministros n.º 62/2004, de 17 de Maio, que passam a ter a seguinte redacção: '1 -...
