Decreto-Lei n.º 217/2002, de 22 de Outubro de 2002
Decreto-Lei n.º 217/2002 de 22 de Outubro O Observatório do Comércio foi criado pela Resolução do Conselho de Ministros n.º 54/98, de 23 de Abril, como estrutura de missão temporária da administração central do Estado, e mantido em funcionamento pelas Resoluções do Conselho de Ministros n.os 28/2000, de 17 de Maio, e 77/2002, de 11 de Abril, com o objectivo de assegurar um fórum de discussão e de promoção de estudos relativo ao sector do comércio.
O Observatório do Comércio é uma das estruturas extintas nos termos da alínea a) do n.º 2 do artigo 2.º da Lei n.º 16-A/2002, de 31 de Maio, pelo que, nos termos do n.º 3 do mesmo preceito, cumpre efectivar a cessação de funções do pessoal dirigente, bem como regular a reafectação do respectivo pessoal e património e dos respectivos direitos e obrigações.
Assim: Nos termos da alínea a) do n.º 1 do artigo 198.º da Constituição, o Governo decreta o seguinte: Artigo 1.º Objecto O presente diploma regula o processo de extinção, previsto no artigo 2.º da Lei n.º 16-A/2002, de 31 de Maio, do Observatório do Comércio, criado pela Resolução do Conselho de Ministros n.º 54/98, de 23 de Abril.
Artigo 2.º Prazo O processo de extinção do Observatório do Comércio tem o seu termo no prazo de 15 dias a contar da data da entrada em vigor do presente diploma.
Artigo 3.º Pessoal 1 - O pessoal com vínculo à função pública, afecto ao Observatório do Comércio, regressará aos respectivos lugares de origem.
2 - Os contratos celebrados nos termos do n.º 5.2 da Resolução de Conselho de Ministros n.º 54/98, de 23 de Abril, caducam com o termo do processo de extinção do Observatório do Comércio.
Artigo 4.º Património 1 - O património imobiliário e veículos afectos ao Observatório do Comércio são entregues à Direcção-Geral do Património.
2 - Os direitos, posições contratuais e obrigações assumidos pelo Observatório do Comércio, bem como os bens que lhe estão afectos, sem prejuízo do disposto no número anterior, incluindo o acervo documental, transitam para a Direcção-Geral do Comércio e da Concorrência, sem...
