Decreto-Lei n.º 295/97, de 24 de Outubro de 1997
Decreto-Lei n.º 295/97 de 24 de Outubro Compete ao Instituto da Vinha e do Vinho (IVV), nos termos da alínea h) do n.º 5 do artigo 2.º do Decreto-Lei n.º 99/97, de 26 de Abril, aplicar as coimas e outras sanções acessórias devidas nos processos de contra-ordenação, por infracções às normas que regulam a matéria da vinha e a produção e comércio do vinho e dos produtos de origem vitivinícola, nos termos do direito interno e comunitário em vigor.
Mostra-se adequado, para além do que se encontra genericamente estatuído no seu diploma orgânico, integrar, no mesmo, normas que confiram ao IVV as competências atribuídas nos termos do Decreto-Lei n.º 28/84, de 20 de Janeiro, ao ex-Instituto da Qualidade Alimentar e à Comissão Nacional de Aplicação de Coimas em Matéria Económica, relativas à apreciação de determinadas contra-ordenações previstas no citado diploma, e à aplicação das correspondentes coimas, sempre que esteja em causa o incumprimento das diposições legais aplicáveis em matéria de vinha e de produção e comercialização do vinho e dos produtos de origem vitivinícola, cabendo igualmente ao IVV idêntica competência relativamente a outras contra-ordenações explicitamente previstas em legislação avulsa aplicável ao sector.
Assim: Nos termos da alínea a) do n.º 1 do artigo 198.º da Constituição, o Governo decreta o seguinte: Artigo 1.º 1 - Ao n.º 4 do artigo 2.º do Decreto-Lei n.º 99/97, de 26 de Abril, são aditadas as seguintes alíneas: 'h) Aplicar as coimas e sanções acessórias relativamente às contra-ordenações previstas nos artigos 58.º e 59.º, na alínea c) do n.º 1 do artigo 64.º e nos artigos 61.º, 66.º, 67.º, 68.º, 69.º e 70.º do Decreto-Lei n.º 28/84, de 20 de Janeiro, sempre que se trate de infracções relativas ao não cumprimento de disposições legais aplicáveis...
