Decreto-Lei n.º 83/2003, de 24 de Abril de 2003
Decreto-Lei n.º 83/2003 de 24 de Abril Tem-se registado nos últimos anos um aumento significativo do recurso ao crédito por pessoas singulares. Incluída no contexto de resposta a preocupações referentes à prevenção do sobreendividamento, encontra-se a adopção de medidas que contribuam para que as entidades responsáveis pela concessão de crédito possam dispor de mais elementos relevantes na avaliação do risco de crédito.
Ainda que todas as instituições de crédito possam aceder às informações da Central de Riscos de Crédito do Banco de Portugal, tem sido reconhecido que apenas as que exercem actividades de captação de depósitos e de movimentação dos mesmos através de cheques têm acesso à informação do Banco de Portugal sobre utilizadores de cheque que oferecem risco. Daí resulta, para as demais instituições de crédito, a ausência de um elemento essencial para a análise, controlo e prevenção do risco de crédito, o que não se coaduna com os deveres prudenciais estabelecidos e cujo cumprimento é impostouniformemente.
Sendo a informação relativa aos utilizadores de cheque que oferecem risco essencial para a eficácia da referida avaliação do risco de crédito, revela-se necessário autorizar o acesso, por parte de todas as instituições de crédito indicadas como tal no artigo 3.º do Regime Geral das Instituições de Crédito e Sociedades Financeiras, aprovado pelo Decreto-Lei n.º 298/92, de 31 de Dezembro, às informações do Banco de Portugal sobre inibidos do uso do cheque, relevantes para a avaliação do risco de crédito.
Foram ouvidos o Banco de Portugal, a Associação Portuguesa de Bancos, a Associação de Sociedades Financeiras para Aquisições a Crédito e a Comissão Nacional de Protecção de Dados.
