As decisões proferidas pelos tribunais estrangeiros relativas ao estado e capacidade civil dos portugueses só depois de revistas e confirmadas podem ser averbadas aos assentos respectivos, tal como resulta do estipulado no artigo 7.° do Código de Registo Civil. A confirmação e revisão de sentenças estrangeiras são feita nos termos do estabelecido no artigo 1094.° e seguintes do Código de Processo Civil.
Não estão sujeitas a revisão e confirmação as sentenças proferidas em acções de estado ou registo decretadas em:
* Cabo Verde
* S. Tomé e Príncipe
Relativas a Portugueses ou nacionais destes Estados sendo averbadas directamente nos assentos respectivos.
As decisões dos tribunais eclesiásticos, respeitantes à nulidade do casamento ou dispensa de casamento rato e não consumado, são averbadas directamente ao assento de casamento sem ser necessário a sua revisão e confirmação, tal como resulta do estipulado no artigo 7.°, n.° 3 do Código de Registo Civil. Com a entrada em vigor em 1 de Março de 2001 do Regulamento (CE) n.° 1437/2000 do Conselho, de 29 de Maio de 2000, revogado pelo Regulamento (CE) n.° 2201/2003 do Conselho de 27 de Novembro de 2003 e este último alterado pelo Regulamento (CE) n.° 2116/2004 do Conselho de 2 de Dezembro, deixou de ser necessário proceder à revisão e confirmação das decisões em matéria matrimonial.
As decisões em matéria parental, sujeitas ao regime do Regulamento (CE) n.° 2201/2003 do Conselho de 27 de Novembro de 2003, tem que ser declaradas executórias nos termos do artigo 28.° deste Regulamento.
Encontra-se publicado um estudo no Boletim dos Registos e do Notariado n.° 7/2001 sobre o âmbito de aplicação do Regulamento (CE) n.° 1347/2000 do conselho de 29 de Maio de 2000.
