Considerando que, através dos nºs 4 a 8 da Resolução nº 75/98, de 2 de Abril, foi autorizada a cedência, a título precário e gratuito, à Agespi - Associação para a Gestão do Parque Industrial da Ilha Terceira, das parcelas de terreno afectas a esse Parque Industrial, sito à freguesia do Cabo da Praia, concelho da Praia da Vitória, inscritas na respectiva matriz predial sob os artigos rústicos 91º, 1760º a 1763º, 1970º, 176º, 1798º, 201º, 191º, 192º, 198º e 1611º e descritas na Conservatória do Registo Predial da Praia da Vitória, sob os nºs 32048, 30128, 30129, 30425, 30130, 32500, 737, 32499, 4206, 1027, 32529, 31716 e 31715;
Considerando que se torna necessária a constituição do direito de superfície sobre as parcelas atrás referidas a favor da Agespi;
Assim, nos termos da alínea b) do artigo 60º do Estatuto Político-Administrativo da Região Autónoma dos Açores, o Conselho do Governo resolve:

Autorizar a constituição do direito de superfície a favor da Agespi - Associação para a Gestão do Parque Industrial da Ilha Terceira, sobre as parcelas de terreno que integram o Parque Industrial da Ilha Terceira, inscritas na matriz predial rústica da freguesia do Cabo da Praia, concelho da Praia da Vitória, sob os artigos 91º, 1760º, 1761º, 1762º, 1763º, 1970º, 176º, 1798º, 201, 191º, 192º, 198º e 1611º e descritos na Conservatória do Registo Predial da Praia da Vitória sob os nºs 32048, 30128, 30129, 30425, 30130, 32500, 737, 1066, 1052, 1027, 1067, 1054 e 1053, respectivamente.
