A Resolução do Conselho de Ministros n.° 115/98, de 1 de Setembro, que criou a Iniciativa Nacional para o Comércio Electrónico, estabelece como um dos objectivos a concretizar no seu âmbito a definição de um quadro legislativo e regulamentar que crie as condições necessárias ao pleno desenvolvimento do comércio electrónico. Um dos diplomas que, neste contexto, expressamente se refere como devendo ser adoptado é o definidor do regime jurídico aplicável às facturas electrónicas.
Por seu lado, a Resolução do Conselho de Ministros n.° 119/97, de 14 de Julho, que adoptou as bases gerais da reforma fiscal para o século XXI, preconiza a implementação das novas tecnologias da comunicação nos sistemas tributários.
O comércio electrónico implica uma profunda transformação das práticas comerciais tradicionais e, com ela, do quadro legislativo que as regula. De facto, importa que ao nível legislativo se criem as condições para que o comércio electrónico se possa desenvolver harmoniosamente. Há, por isso, que legislar no sentido de criar um ambiente favorável à actuação no quadro da economia digital, removendo-se as barreiras ao pleno desenvolvimento do comércio electrónico e estimulando a confiança que nele devem ter os diferentes agentes económicos.
Um dos objectivos que, neste âmbito, importa assegurar é o do reconhecimento da factura electrónica. Num mundo em que as transacções se processam de computador para computador não faz sentido exigir que as facturas sejam passadas para papel e arquivadas nesse suporte. É hoje possível assegurar a fidedignidade e integridade dos documentos electrónicos por meios que asseguram uma qualidade muito superior aos existentes para o suporte papel.
Nestas condições, a desmaterialização da factura e a correspondente introdução no ordenamento jurídico português do princípio de equiparação entre as facturas emitidas em suporte papel e as facturas electrónicas aparece como uma condição essencial ao desenvolvimento do comércio electrónico. Com esta medida beneficiarão ainda toda a actividade económica e o comércio, entendido aqui no seu sentido mais amplo.
