Decreto-Lei n.º 425/86 de 27 de Dezembro Na difusão dos mecanismos de arbitragem voluntária estará uma das vias para desbloquear a actividade dos tribunais; dá-se, para mais, a circunstância de as experiências comparatísticas revelarem que este meio alternativo da justiça judicial possui virtualidades de realização de uma justiça igualmente certa e dignificada.
Acontece que para a difusão dessas soluções arbitrais contribuirá, de modo muito significativo, a existência de centros a funcionar, institucionalizada e permanentemente, como que profissionalizando a actividade; tais centros de arbitragem tendem, nos países com uma vida económica mais intensa, a absorver muito do que antes estava imputado a arbitragens ad hoc. Isso mesmo foi sublinhado na exposição de motivos da proposta de lei n.º 34/IV, que deu origem à Lei n.º 31/86, de 29 de Agosto.
Cabe, no entanto, dar execução ao estabelecido no artigo 38.º desta lei. É o que agora se faz, tendo em vista o comando dimanado da Assembleia da República.
Procurou-se, ao dar-lhe cumprimento, congregar o objectivo de não cometer ao Governo, através do Ministro da Justiça, uma discricionariedade não controlável, com o de não prefixar critérios legais excessivamente rígidos, que desvirtuariam a natural flexibilidade do sistema.
Assim, em desenvolvimento do artigo 38.º da Lei n.º 31/86, de 29 de Agosto: O Governo decreta, nos termos da alínea c) do n.º 1 do artigo 201.º da Constituição, o seguinte: Artigo 1.º - 1 - As entidades que, no âmbito da Lei n.º 31/86, de 29 de Agosto, pretendam promover, com carácter institucionalizado, a realização de arbitragens voluntárias, devem requerer ao Ministro da Justiça autorização para a criação dos respectivos centros.
2 - No requerimento referido no número anterior as entidades interessadas devem expor circunstanciadamente as razões que justificam a sua pretensão, delimitando o objecto das arbitragens que pretendem levar a efeito.
Art. 2.º Ao apreciar os pedidos formulados nos termos do artigo anterior, o Ministro da Justiça deve tomar em conta a representatividade da entidade requerente e a sua idoneidade para a prossecução da actividade que se propõe realizar, com vista a verificar se estão...
