Aviso n.º 528/2006 Por ordem superior se torna público que, por notificação de 6 de Agosto de 2004, o Ministério dos Negócios Estrangeiros do Reino dos Países Baixos comunicou ter a Hungria, em 13 de Julho de 2004, aderido à Convenção sobre a Obtenção de Provas no Estrangeiro em Matéria Civil ou Comercial, adoptada na Haia em 18 de Março de 1970.
Nos termos do artigo 39.º, n.º 3, a Convenção entrou em vigor para a Hungria em 11 de Setembro de 2004.
Nos termos do artigo 39.º, n.º 4, da Convenção, a adesão produz efeitos apenas entre a Hungria e os Estados Contratantes que hajam declarado aceitar a referida adesão.
Nos termos do artigo 39.º, n.º 5, a Convenção entrou em vigor entre a Hungria e o Estado que tiver declarado a sua aceitação no 60.º dia após o depósito da declaração de aceitação.
No momento da adesão foram realizadas as seguintes declarações: 'To article 2 In the Republic of Hungary the Ministry of Justice is designated as the Central Authority in accordance with article 2 of the Convention.
To article 8 Members of the judicial personnel of the requesting authority may be present at the execution of a Letter of Request executed by the requested court, subject to prior permission by the Hungarian Central Authority.
To article 15 In accordance with article 15 of the Convention the diplomatic officer or consular agent of a Contracting State may in the territory of the Republic of Hungary take the evidence in aid of proceedings commenced in the courts of a state which he represents without prior permission of the Hungarian authorities provided that the person affected is exclusively national of the sending state of the diplomatic officer or consular agent. Taking of evidence shall not involve applying or holding out of the prospect of compulsion or disadvantageous legal consequences.
To article 17 In the Republic of Hungary the Central Authority is entitled to give the permission set out in paragraph 2 of article 17 of the Convention.
To article 23 The Hungarian authorities will not execute Letters of Request issued for the purpose of obtaining pre-trial discovery of documents.'
