Sumário: I - A parte final da alínea a) do nº 1 do artigo 2166 do Código Civil, com a expressão " desde que ao crime corresponda pena superior a seis meses de prisão " refere-se a crime punível com prisão no seu limite máximo superior a seis meses de prisão, sendo, pois, pressuposto referencial da exclusão de sucessível ( deserdação ) a moldura abstracta da pena prevista para o crime ( pena correspondente ) e não a pena aplicada. II - Por conjugação dos artigos 974 e 2166, nº 1, alínea a) do Código Civil, é sancionável com a revogação da doação a conduta da destinatária, se for superior a seis meses de prisão o máximo da pena prevista para o...
