Sumário : I - Face ao disposto no artigo 50 do Decreto n. 360/71, de 21 de Agosto, na redacção do Decreto-Lei 459/79, de 23 de Dezembro, a incapacidade a ter em conta - inferior, igual ou superior a 50% - e a incapacidade para o exercicio da profissão habitual. A capacidade residual para exercer outra profissão compativel releva apenas para a fixação do montante da pensão entre o maximo e o minimo previstos para cada caso 2/37 e 1/3 da retribuição-base - cfr Base XVI, n. 1, alinea b) da lei 2127, de 03/08/65.
