Nas páginas anteriores (páginas 61 e 65) dissemos que a questão central não está na lei de finanças regionais (LEFRA) e nem sequer no Estatuto, mas sim na Constituição, que o estatuto financeiro merece estar no Estatuto Político-Administrativo devido especialmente à imperfeição constitucional, que da maneira que o instituto está se acolhem as autonomias como se de uma autarquia local se tratassem, como se fosse apenas e só uma questão financeira quando em rigor o poder financeiro não é menos importante do que o poder legislativo.42 E concluímos que um sistema assim avulso sujeita-se ao balanço partidário e político, a autonomia é diminuída e prensada aos caprichos dos governantes circunstâncias estaduais. Desaparece, concluímos ainda, a autonomia política e reaparece algo híbrido sem contexto histórico e jurídico.
O que não queríamos, e que afinal acabamos por fazer agora, era falar sobre uma "nova" lei que ainda não é lei porque não está aprovada, promulgada e publicada.43 Mas a pertinência do assunto e a solicitação de amigos justificam que falemos daquilo que ainda não é (e que previsivelmente será muito em breve porque já em discussão no parlamento nacional o texto que serve de base à nossa análise).
A questão central é esta: a nova LEFRA viola a Constituição Portuguesa e o Estatuto Político- -Administrativo? A resposta é afirmativa. Já concluímos isso. Mas não se trata de uma violação meramente de norma; vai mais longe, atinge o próprio sistema autonómico.
A Constituição prevê que a Assembleia da República faça a LEFRA e na parte relativa às regiões autónomas prevê que a autonomia financeira daquelas se rege por aquela lei. Mas há entre estas duas normas e outras duas normas, também constitucionais, um choque: num caso, uma determina que as regiões autónomas são dotadas de Estatuto a outra estabelece que as regiões autónomas têm poderes definidos no Estatuto. As que prevêem a LEFRA foram criadas pela Revisão Constitucional de 1997, enquanto as outras duas já são normas muito anteriores. Ou seja, a previsibilidade de a "autonomia financeira" estar desenvolvida em lei que não seja o Estatuto contradiz a Constituição.
A nova LEFRA também viola o Estatuto Político-Administrativo. Na panóplia discursiva do Estatuto retiram-se dois princípios basilares: que é necessário garantir aos órgãos de governo próprio os meios para a prossecução de suas atribuições com vista do desenvolvimento das Page 71 populações; e que é necessário...
