Em certo sentido a autonomia política insular é um facto extraordinário: olhando as ilhas espalhadas por esse mundo afora, e bastando-nos focar apenas exemplos das ilhas dos países mais evoluídos do mundo moderno1, o caso português é digno de registo. Não porque os governos das ilhas sejam bons ou menos bons; não porque os governos destas tenham ou não um projecto político e democrático de propriedades inadequadas. Mas pelo simples facto de lhes serem atribuídos pela História, pela Cultura Cívica e pela Constituição, um estatuto político com órgãos próprios, com atribuições legislativas e administrativas, com património e orçamentos próprios. Visto da perspectiva histórica, a autonomia não tem essa relevância; tem, e muita, é certo, mas olhando "para trás", ela é natural porque corresponde a um evolução que já arrumámos em três períodos: o primeiro período, Antiguidade da autonomia administrativa, do Século XV a 1895 (coincide com certa evolução histórica do Estado português, Estado Absoluto e o Estado Constitucional Liberal, Constituições de 1822, 1826-Carta, 1838 e 1911); o segundo período, Adaptação da autonomia administrativa, de 1895 a 1976 (também algo coincidente com o Estado Constitucional Autocrático, Constituição de 1933); e o terceiro período, de 1976 aos nossos dias, Criação da autonomia político-administrativa (que coincide com o Estado Constitucional Democrático de Direito, Constituição de 1976).2
Mitologia3 e realidade são palavras que, juntas, pode estranhar-se à partida porque a autonomia política dos Açores é uma realidade com trinta anos de existência e, portanto, as duas Page 4 expressões juntas parece colidirem. Mas bem vistas as coisas existe em toda essa "realidade" uma forte componente ilusória, sobretudo na parte fundamental da autonomia política e constitucional e que é o poder de criar leis. Este livro é um contributo para a compreensão dessa dicotomia.
São dois os motivos que levam esta obra à mão do leitor. Em Abril de 2001, num programa de rádio a propósito dos vinte cinco anos da autonomia insular4, falámos, e julgo que pela primeira vez em Portugal, em dois princípios: o da permanência mínima e o da primazia institucional. O da permanência mínima é um paradigma do princípio da igualdade de todos os portugueses. Na generalidade quer significar que os portugueses nas regiões insulares autonómicas têm direito a que os direitos existentes para os outros portugueses se mantenham iguais nas duas regiões autónomas dos Açores e da Madeira. A autonomia política justifica-se, nunca para baixar nas ilhas o que a nível nacional existe, mas exclusivamente para, no mínimo, manter esse nível, ou seja, os requisitos de acessibilidade a nível nacional que obrigam os cidadãos não podem ser aumentados a nível regional.5 Na especialidade isso tem outras ramificações: que nem os açorianos tenham mais desproporcionadamente nem menos ilegalmente quando comparados com os outros portugueses. O princípio da primazia institucional pode ter várias ramificações. Por um lado, ao nível interno, isto é, entre órgãos da própria região; de igual modo entre os órgãos regionais e os de soberania ou seus representantes. No fundo, portanto, trata-se de um ramal dos princípios da separação de poderes e da subsidieriedade que, no sistema autonómico, isto é, no modelo de Estado unitário regional, ganham um relevo profundo e que a prática mostra com algum vigor.6
